Purchase and Sale Rules

General Provisions

1.1. These Goods Purchase and Sale Rules (hereinafter – the Rules) establish the mutual rights, obligations, and responsibilities between the person (hereinafter – the Buyer) ordering goods from the online store www.namuideja.lt and MB "Namų Idėja" (Insurer code: 3351936, VAT payer code: LT100012021617, hereinafter – the Seller). By purchasing goods, the Buyer agrees to the application of these Rules. By confirming the rules, the Buyer confirms that, in accordance with these Rules, they may order and purchase goods.

1.2. The Seller reserves the right to change, correct, or supplement the Rules at any time, taking into account legal requirements.

1.3. The right to purchase from the online store www.namuideja.lt is granted to:

  • 1.3.1. Able-bodied natural persons;
  • 1.3.2. Legal entities;
  • 1.3.3. Authorized representatives of the aforementioned persons.

Personal Data Protection

2.1. When purchasing goods, the Buyer must provide correct data: name, surname, email, phone number, address. The Buyer is responsible for the accuracy of this data.

2.2. All personal data provided by the Buyer is processed in accordance with the Seller's personal data protection policy. Personal data is not disclosed to third parties, except in cases where legal acts require their disclosure.

Moment of Conclusion of the Distance Purchase-Sale Agreement

3.1. At the time of placing an order, the Buyer receives an automatic email notification confirming receipt of the order. This confirmation does not mean that the contract has already been concluded. The contract becomes binding only upon receipt of delivery confirmation. Due to unforeseen reasons, an order may be rejected before delivery confirmation. We recommend saving the delivery confirmation for future reference.

3.2. The distance contract is considered concluded when the Buyer confirms the order and agrees to the price of the goods, receives order confirmation, and pays the invoice electronically. Payment is considered the Buyer's consent to the Rules.

3.3. If the Buyer does not agree with the terms of the Rules, they do not have the right to place an order or conclude a contract.

Buyer's Rights

4.1. The Buyer has the right to purchase goods in accordance with the Rules and the laws of the Republic of Lithuania.

4.2. The Buyer may withdraw from the contract by notifying the Seller by email within 14 days of receiving the goods.

4.3. The Buyer may return goods if they have not lost their commercial appearance, are undamaged, and unopened.

4.4. If the returned goods do not meet the requirements of clause 4.3, the Seller may refuse to accept the goods.

4.5. The Buyer cannot reject goods that were produced according to individual order or adapted to the Buyer's needs, except for specified exceptions.

Buyer's Obligations

5.1. The Buyer must pay for the goods and accept them according to the established procedure.

5.2. The Buyer undertakes to keep login data secure and immediately inform the Seller of their loss.

5.3. The Buyer must update their data if it changes.

5.4. The Buyer undertakes to comply with the Rules and applicable legal acts.

Seller's Rights

6.1. The Seller may restrict or suspend the Buyer's access to the store if the latter violates the Rules.

6.2. The Seller may temporarily or permanently cease the store's operations without prior notice.

6.3. The Seller may cancel an order if the Buyer does not pay the invoice within the specified period.

6.4. The Seller may change the Rules by publishing the changes on the store's website.

Seller's Obligations

7.1. The Seller undertakes to ensure that the store operates properly and buyers can use all services.

7.2. If it is necessary to replace an undelivered item, the Seller will offer an alternative or refund the money.

7.3. The Seller will comply with all obligations set forth in the Rules.

Product Prices, Payment Procedure, and Terms

8.1. Product prices are indicated in euros, including VAT. The Seller reserves the right to change product prices.

8.2. The Buyer pays for the goods by the following methods:

  • 8.2.1. Advance payment by simple bank transfer – payment is made by simple bank transfer to the specified Seller's account. The invoice must be paid within 2 working days. If the invoice is not paid within this period, your order will be cancelled.
  • 8.2.2. Cash payment upon collection of goods.
  • 8.2.3. Payment can be made using Swedbank, SEB, Luminor, Citadele, and Šiaulių bankas electronic banking services. Payments are processed using the MakeCommerce.lt payment platform.

8.3. In all cases, the Seller is released from responsibility if the Buyer pays for the order not from their personal account; in such a case, the Buyer has no right to make claims against the Seller regarding the delivery of goods to an inappropriate entity. Except in cases where delivery to the wrong entity occurs due to the Seller's fault.

Delivery of Goods

9.1. When ordering goods, the Buyer undertakes to collect the goods from the Seller's warehouse or agrees to delivery to the address specified during the order.

9.2. The Seller delivers the goods to the Buyer within the terms previously agreed upon with the Buyer. The Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the terms of goods delivery. A delay of up to 30 days in delivering goods to the Buyer from the agreed delivery time is not considered a material breach of contract.

9.3. Other information related to goods delivery is provided in the "Payment and Delivery" section of the online store.

Product Quality Guarantee, Returns, and Exchanges

10.1. Products come with a 24-month warranty, as stipulated by law.

10.2. Article 6.338 of the Civil Code of the Republic of Lithuania sets out the terms for making claims regarding product defects.

10.3. The warranty is valid throughout the territory of the Republic of Lithuania.

10.4. The warranty applies to product quality defects arising due to the manufacturer's fault.

10.5. The Seller will rectify or replace goods with quality non-conformities found during the warranty period at its own expense.

10.6. If the ordered products are manufactured according to the customer's needs and conditions, the goods cannot be returned.

Responsibility

11.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form.

11.2. The Buyer is responsible for actions performed using the online store.

11.3. The Buyer is responsible for transferring their login data to third parties. If a third party uses the services provided in the online store using the Buyer's login data, the Seller considers this person to be the Buyer.

11.4. The Seller is released from any liability in cases where losses arise due to the Buyer, disregarding the Seller's recommendations and their obligations, failing to familiarize themselves with these Rules.

11.5. If the Seller's online store contains links to websites of other companies, institutions, organizations, or persons, the Seller is not responsible for the information or activities carried out there, does not supervise or control those websites, and does not represent those companies and persons.

11.6. In case of damage, the guilty party compensates the other party for direct losses.

Information Exchange

12.1. The Seller sends all notifications to the email address provided by the Buyer in the registration form.

12.2. The Buyer sends all notifications and questions using the contact methods specified in the "Store Information" section of the Seller's website.

Final Provisions

13.1. These rules are drawn up in accordance with the laws of the Republic of Lithuania.

13.2. Relations arising from these rules are governed by the laws of the Republic of Lithuania.

13.4. All disagreements arising from the execution of these rules shall be settled through negotiations. If an agreement cannot be reached, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
